DMCA Policy

Digital Millennium Copyright Act takedown and counter-notification procedures. Last updated: April 2026.

Overview

Lustify respects the intellectual property rights of others and expects its operators to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Lustify will respond to valid takedown notices and may remove or disable access to content that infringes copyright.

Filing a DMCA Takedown Notice

If you believe that content on the Lustify platform infringes your copyright, you may submit a takedown notice containing the following information:

  1. Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a representative list.
  2. Identification of the infringing material — A description of the material you claim is infringing and sufficient information to allow us to locate it on the Platform (e.g., URL, username, description of content).
  3. Your contact information — Your name, mailing address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
  6. Signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Processing of Takedown Notices

Upon receiving a valid DMCA takedown notice, Lustify will:

Counter-Notification

If you are an operator whose content has been removed and you believe the removal was a mistake or that you have authorization to use the content, you may file a counter-notification containing:

  1. Identification of the material — A description of the material that was removed and its location before removal.
  2. Good faith statement — A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  3. Your contact information — Your name, address, and telephone number.
  4. Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Lustify may be found, and that you will accept service of process from the person who filed the original takedown notice or their agent.
  5. Signature — Your physical or electronic signature.

Restoration of Content

If Lustify receives a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, Lustify may restore the removed content.

Non-Consensual Intimate Imagery (TAKE IT DOWN Act)

Separately from the DMCA process above, if you are a victim of non-consensual intimate imagery — including AI-generated or digitally altered content depicting you — you can request removal under the TAKE IT DOWN Act (47 U.S.C. § 230(r)). This law was created to give victims a fast, clear path to get non-consensual intimate content removed.

We will remove qualifying content within 48 hours of receiving a valid request. To submit a TAKE IT DOWN Act removal request, contact @lustifydevadmin on Telegram with:

This process does not require the same formal notice structure as a DMCA takedown. We comply with this law because protecting people from non-consensual intimate content is the right thing to do.

Repeat Infringers

Lustify maintains a policy of terminating the accounts of operators who are repeat infringers. Operators who receive multiple valid DMCA takedown notices may have their accounts permanently terminated. Earned balances are handled according to the tiered enforcement process described in our Content Policy.

Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
