This Content Creator Agreement ("Agreement") is a binding contract between you ("Operator," "Creator," or "you") and Lustify ("Platform," "we," or "us"). By creating an account, uploading content, or distributing material through the Platform, you agree to all terms in this Agreement. This Agreement supplements the Terms of Service — in the event of a conflict, the more restrictive provision applies.
To operate as a content creator on Lustify, you must:
Your KYC verification must remain current. If your identity documents expire or your information changes, you must update your records within 30 days. Failure to maintain current verification may result in payout holds until verification is re-established.
All content you create, upload, or distribute through the Platform must comply with the following standards, in addition to the rules in our Content Policy:
When your content features any real person other than yourself, you bear full responsibility for documenting their consent and verifying their age. This is not a suggestion — it is a legal obligation under 18 U.S.C. § 2257 and your primary defense against future claims.
If a depicted person claims they did not consent, or if a legal or regulatory authority asks for proof, your documentation is the only thing that protects you. Lustify cannot verify consent on your behalf — we can only verify that you submitted the required documents. The underlying consent relationship is between you and the depicted person.
Lustify charges a platform fee on revenue earned through the Platform. The applicable fee rate is disclosed in your operator dashboard and is frozen at the time of each individual sale. Changes to the platform fee rate do not retroactively affect previously completed transactions.
If a buyer disputes a payment (chargeback), the disputed amount will be deducted from your balance. If the dispute is resolved in your favor, the funds will be restored. Excessive chargeback rates may result in account review and possible suspension of payment processing.
You are solely responsible for reporting and paying all taxes due on income earned through the Platform. Lustify does not withhold taxes on your behalf unless required by law. You agree to provide any tax documentation we may reasonably request (e.g., W-9, W-8BEN) to comply with our reporting obligations.
You agree to indemnify, defend, and hold harmless Lustify and its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:
This indemnification obligation survives the termination of your account and this Agreement.
If someone sues Lustify because of something you did, you are responsible for the cost. This includes situations where a depicted person claims they didn't consent, a buyer claims fraud, a copyright holder claims infringement, or a government authority takes action based on your content. Proper documentation and compliance with Platform policies are your best protection against these scenarios.
You retain full ownership of all content you upload to the Platform. By uploading content, you grant Lustify a limited, non-exclusive, worldwide, royalty-free license to:
This license terminates when you remove the content from the Platform, except that Lustify may retain copies as required by law or for the resolution of ongoing disputes. Lustify does not sublicense your content to third parties or use it for purposes unrelated to the operation of the Platform.
By entering into this Agreement, you represent and warrant that:
You may terminate this Agreement at any time by closing your Lustify account. Upon voluntary termination:
Lustify may terminate this Agreement and your account in accordance with the enforcement tiers described in our Content Policy. In all cases except a confirmed CSAM hash match (Tier 3), your earned balance is not forfeited and will be released after the chargeback reserve period.
The following obligations survive termination of this Agreement regardless of the reason for termination: indemnification (Section 5), record retention, tax responsibilities, and any obligation arising from content distributed prior to termination.
If you grant other users access to your account (chatters, managers, or other team members), you are fully responsible for their actions on your account. This includes:
You must ensure that all team members understand and comply with this Agreement, the Content Policy, and all other Platform policies. "I didn't know my team member did that" is not a defense — the account holder is always responsible.
Lustify may modify this Agreement at any time. Material changes will be communicated through the Platform at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance. If you do not agree with a modification, you may terminate your account before the effective date.
Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the governing law provisions in our Terms of Service. Before initiating arbitration, both parties agree to attempt good-faith resolution by contacting each other directly. Most disputes can be resolved without formal proceedings.
