18 U.S.C. § 2257 Compliance Statement

Record-keeping requirements for content featuring real individuals. Last updated: April 2026.

Overview

18 U.S.C. § 2257 and 28 C.F.R. Part 75 require certain record-keeping obligations for producers of actual sexually explicit content depicting real people. This statement explains how Lustify and its operators comply with these requirements.

Important: This applies to real people only

Section 2257 record-keeping requirements apply specifically to content depicting real, identifiable human beings engaged in actual sexually explicit conduct. If your content features only AI-generated personas, fictional characters, or digitally created individuals with no real person's likeness, the 2257 record-keeping requirements described on this page do not apply to that content.

However, if your AI-generated content is based on or uses the likeness of a real, identifiable person, all 2257 requirements apply as if that person were physically present. The determining factor is whether a real person's identity is depicted, not how the content was produced.

Lustify's Role

Lustify operates as a technology platform that enables operators to manage and distribute content. Lustify is not the primary producer of content uploaded by operators. Each operator who uploads, manages, or distributes sexually explicit content through the Platform is considered the producer of that content for purposes of 18 U.S.C. § 2257 and is responsible for compliance with all applicable record-keeping requirements.

Operator Obligations

As a producer of sexually explicit content, each operator must:

Verify age — Obtain and review a valid, government-issued photo identification document for every individual depicted in sexually explicit content before that content is uploaded to the Platform. All performers must be at least 18 years of age.
Maintain records — Create and maintain records that include:
- The legal name of each performer
- Any aliases, stage names, or other names used by the performer
- Date of birth
- A copy of the government-issued photo ID used to verify age
- A description or title of each piece of content in which the performer appears
Retain records — Maintain these records for a minimum of seven (7) years from the date of production or last publication, whichever is later.
Make records available — Produce records upon lawful request by the Attorney General or their designee.
Designate a custodian — Each operator must designate a custodian of records and provide the custodian's name and business address. Submit your custodian designation to @lustifydevadmin on Telegram with the custodian's full legal name and business address. We will confirm receipt and store this information on file. If your custodian changes, notify us promptly.

Lustify's Compliance Measures

To support compliance, Lustify:

Requires all operators to agree to maintain 2257-compliant records as a condition of using the Platform
Reserves the right to request proof of age verification documentation from operators at any time
Will immediately terminate the account of any operator who fails to produce adequate records upon request
Reports suspected CSAM to the National Center for Missing and Exploited Children (NCMEC) and law enforcement

Exemption Notice

Content that does not depict actual sexually explicit conduct as defined in 18 U.S.C. § 2256(2)(A) is exempt from the record-keeping requirements of § 2257. This includes content that is simulated, text-only, or otherwise does not constitute actual sexually explicit conduct. Purely AI-generated content featuring fictional personas with no real person's likeness is also exempt, as no real individual is depicted. If you operate exclusively with AI-generated personas that are not based on real people, you do not need to maintain 2257 records for that content.
